Navy Civilian Employee Cleared From Relationship with Foreign Officer

WASHINGTON, DC - Department of the Navy civilian employee was issued Letter of Intent (LOI)/Statement of Reasons (SOR) to revoke eligibility for security clearance and assignment to a sensitive position, under Adjudicative Guideline: B - Foreign Influence, E - Personal Conduct, and K - Handling Protected Information due to Post-Test (polygraph) interview with the FBI as result of developing a personal relationship with a foreign military officer and, over a one-year period assisting the foreign officer's family, social interactions, probable discussions about military operations, logistical, transportation, engineering capabilities, debarkation and time movement nodes, US chemical and biological capabilities, and military units reporting responsibilities per operations plans; other foreign contacts and failure to disclose those other foreign contacts. After presentation of a substantial response, DON CAF GRANTED THE CLEARANCE and favorable suitability determination.

Marine Corps O-5 Cleared from Misuse of Classified Documents

SOUTHEAST - Marine Corps O-5 was issued Letter of Intent (LOI)/Statement of Reasons (SOR) to revoke security clearance and access to Sensitive Compartmented Information (SCI), under Adjudicative Guideline: E - Personal Conduct, K - Handling Protected Information, and M - Misuse of Information Technology Systems due to mishandling of classified information by leaving it on a desk; mishandling classified information at work station; sending classified attachment on a NIPR email; having classified documents on NIPR hard drive; dozens of classified documents on a NIPR share drive; being repeatedly counseled on proper handling of classified materials. After DON CAF denied clearance, client retained JAG Defense. After presentation of case at Personal Appearance before Administrative Judge from Defense Office of Hearings and Appeals, the Personnel Security Appeals Board (PSAB) found FOR THE APPELLANT and the clearance was reinstated.

Defense Contractor Receives Security Clearance From Unpaid Debts

MIDDLE ATLANTIC - Applicant Defense Contractor issued a Statement of Reasons (SOR) under Guideline F - Financial Considerations for 14 unpaid debts. After presentation of case at a Hearing the Administrative Judge found FOR THE APPLICANT and granted the clearance.

Defense Contractor Cleared From 18 Unpaid Debts

MIDDLE ATLANTIC - Applicant Defense Contractor issued Statement of Reasons (SOR) under Guideline F - Financial Considerations for 18 unpaid debts and Guideline E - Personal Conduct for failure to disclose financial issues in the SF86. Upon review of detailed Answer to the SOR, and even though a Hearing was requested, the Defense Office of Hearings and Appeals granted the clearance without the necessity of conducting the Hearing - Finding FOR THE APPLICANT.

Applicant For Dept of Energy Access Cleared From Misuse of Ammunition

SOUTHWEST - Applicant for Department of Energy Access issued Statement of Charges (SOC) under Title 10, Code of Federal Regulations Part 710, "Criteria and Procedures for Determining Eligibility for Access to Classified Matter or Special Nuclear Material based upon allegations under Adjudicative Guidelines E - Personal Conduct and J - Criminal Conduct as a result of the wrongful possession and storage and bringing a personal weapon and ammunition into a combat zone in violation of orders and the Geneva Convention; and the wrongful possession and attempted transportation of government ammunition out of a combat zone. After presentation of our case before a DoE Hearing Officer, the finding was FOR THE APPLICANT and granting of the access.

Dual Status Technician Receives Clearance With Debts Over $80,000

SOUTHWEST - Dual status technician issued Letter of Intent (LOI)/Statement of Reasons (SOR) under Adjudicative Guideline F - Financial Considerations Guideline based upon twelve accounts in collection and one judgment, totaling over $50,000.00 as evidenced by multiple credit reports over several years, with there still being eight charge-off, collection, and judgment accounts of over $30,000.00 as of the date of the SOR. After detailed response to specific allegations and substantial whole person evidence, Central Adjudication Facility granted clearance without requiring a Personal Appearance.

Client Receives Interim Clearance for Position with FBI

SOUTHWEST - Client had just received notification of declination of an interim clearance as a Defense Contractor when offered a position with the FBI. Upon then being retained, we assisted the client in satisfactorily addressing, answering, and mitigating all the concerns raised by DoD in their declination of the clearance to assist the client in obtaining approval for the security clearance by the FBI without the necessity of receiving a Statement of Reasons (SOR) or similar procedure by the FBI.

Defense Contractor Cleared from Four DUIs and Related Offenses

SOUTHEAST - Applicant Defense Contractor issued Statement of Reasons (SOR) under Guideline G: Alcohol Consumption for four DUIs in a 5 year period to also include charges of Driving on a suspended license, giving false name to police, disorderly conduct, obstruction of an officer, and leaving the scene of an accident. After presentation of the case at a Hearing the Administrative Judge found FOR THE APPLICANT and the clearance was retained.

Active Duty Service Member Cleared of Financial Charges & Drug Charges

SOUTHEAST - Active duty service member issued Letter of Intent (LOI) / Statement of Reasons (SOR) under Adjudicative Guidelines F - Financial Considerations, G - Alcohol Consumption, and H - Drug Involvement due to 17 different accounts in arrears to include student loans, Veterans Administration, tax lien and consumer credit accounts; use of marijuana on several occasions, to include being the basis for a previous discharge from the military before reenlisting on this enlistment, possession of marijuana, DUI, and excessive consumption of alcohol. After detailed written response to SOR the Central Adjudication Facility (CAF) granted the client's clearance without the client having to go through a Personal Appearance.

Client Cleared from Civil Lawsuit of Due Child Support, Theft, & DUI

SOUTHEAST - Applicant, who is also a Key Management Personnel for the Contractor, was facing difficulties in getting his Personal Security Clearance favorably adjudicated due to concerns arising under Adjudicative Guidelines: J - Criminal Conduct, G - Alcohol Consumption, and E - Personal Conduct due to past issues of felony prosecution for Aggravated Battery and Grand Theft, civil lawsuit for past due child support, and DUI. Delay in granting of Personal Clearance was also negatively affecting Defense Contractor ability to obtain Facility Clearance. The combination of the delays in the two clearances was costing the Contractor the ability to obtain large government contracts. Working with Defense Security Service (DSS), Defense Industrial Security Clearance Office (DISCO), and Defense Office of Hearings and Appeals (DOHA), we were able to quickly provide the necessary mitigating information sufficient to result in an expeditious resolution of the Personal Clearance, thereby also resulting in a favorable adjudication of the Facility Clearance, all of this being accomplished in very short order of just a few days and without the issuance of a Statement of Reasons or the requirement to go through a Hearing, saving the client both time and money and expediting the Contractor's ability to achieved classified contracts.
