MIDDLE ATLANTIC - Civilian employee of the Department of the Navy was issued a Letter of Intent/Statement of Reasons to revoke his security clearance based upon Guideline E – Personal Conduct, Guideline F – Financial Considerations, Guideline G – Alcohol Consumption, Guideline H – Drug Involvement, and Guideline J – Criminal Conduct. Navy Civilian Employee Cleared From Relationship with Foreign Officer

WASHINGTON, DC - Department of the Navy civilian employee was issued Letter of Intent (LOI)/Statement of Reasons (SOR) to revoke eligibility for security clearance and assignment to a sensitive position, under Adjudicative Guideline: B - Foreign Influence, E - Personal Conduct, and K - Handling Protected Information due to Post-Test (polygraph) interview with the FBI as result of developing a personal relationship with a foreign military officer and, over a one-year period assisting the foreign officer's family, social interactions, probable discussions about military operations, logistical, transportation, engineering capabilities, debarkation and time movement nodes, US chemical and biological capabilities, and military units reporting responsibilities per operations plans; other foreign contacts and failure to disclose those other foreign contacts. After presentation of a substantial response, DON CAF GRANTED THE CLEARANCE and favorable suitability determination.

Marine Corps O-5 Cleared from Misuse of Classified Documents

SOUTHEAST - Marine Corps O-5 was issued Letter of Intent (LOI)/Statement of Reasons (SOR) to revoke security clearance and access to Sensitive Compartmented Information (SCI), under Adjudicative Guideline: E - Personal Conduct, K - Handling Protected Information, and M - Misuse of Information Technology Systems due to mishandling of classified information by leaving it on a desk; mishandling classified information at work station; sending classified attachment on a NIPR email; having classified documents on NIPR hard drive; dozens of classified documents on a NIPR share drive; being repeatedly counseled on proper handling of classified materials. After DON CAF denied clearance, client retained JAG Defense. After presentation of case at Personal Appearance before Administrative Judge from Defense Office of Hearings and Appeals, the Personnel Security Appeals Board (PSAB) found FOR THE APPELLANT and the clearance was reinstated.

Applicant For Dept of Energy Access Cleared From Misuse of Ammunition

SOUTHWEST - Applicant for Department of Energy Access issued Statement of Charges (SOC) under Title 10, Code of Federal Regulations Part 710, "Criteria and Procedures for Determining Eligibility for Access to Classified Matter or Special Nuclear Material based upon allegations under Adjudicative Guidelines E - Personal Conduct and J - Criminal Conduct as a result of the wrongful possession and storage and bringing a personal weapon and ammunition into a combat zone in violation of orders and the Geneva Convention; and the wrongful possession and attempted transportation of government ammunition out of a combat zone. After presentation of our case before a DoE Hearing Officer, the finding was FOR THE APPLICANT and granting of the access.

Client Cleared from Civil Lawsuit of Due Child Support, Theft, & DUI

SOUTHEAST - Applicant, who is also a Key Management Personnel for the Contractor, was facing difficulties in getting his Personal Security Clearance favorably adjudicated due to concerns arising under Adjudicative Guidelines: J - Criminal Conduct, G - Alcohol Consumption, and E - Personal Conduct due to past issues of felony prosecution for Aggravated Battery and Grand Theft, civil lawsuit for past due child support, and DUI. Delay in granting of Personal Clearance was also negatively affecting Defense Contractor ability to obtain Facility Clearance. The combination of the delays in the two clearances was costing the Contractor the ability to obtain large government contracts. Working with Defense Security Service (DSS), Defense Industrial Security Clearance Office (DISCO), and Defense Office of Hearings and Appeals (DOHA), we were able to quickly provide the necessary mitigating information sufficient to result in an expeditious resolution of the Personal Clearance, thereby also resulting in a favorable adjudication of the Facility Clearance, all of this being accomplished in very short order of just a few days and without the issuance of a Statement of Reasons or the requirement to go through a Hearing, saving the client both time and money and expediting the Contractor's ability to achieved classified contracts.

Federal Government Employee Cleared After Failure to Disclose Debt

WEST COAST - Federal government employee clearance was denied based uponAdjudicative Guideline - E Personal Conduct - failure to disclose; and F - Financial Considerations - as a result of 8 accounts still being in arrears at time of providing written response to Statement of Reasons. After contacting JAG Defense and consistent with our guidance in demonstrating resolution actions on the debts, employee was successful in mitigating all issues at a Personal Appearance before an Administrative Judge from the Defense Office of Hearings and Appeals resulting in a reinstatement of the clearance by the Personnel Security Appeals Board.

After submitting detailed response explaining errors in investigators summary of the interview, NSA found FOR THE APPLICANT granting SCI access.

Navy GS-15 Cleared After Sexual Affairs While Stationed Abroad

WEST COST - A GS-15 for the Department of the Navy was found to have failed to disclose a number of security issues under Adjudicative Guidelines: E - Personal Conduct, D - Sexual Conduct, B - Foreign Influence, during previous security clearance investigations over a period of 10+ years. These issues included his solicitation of foreign prostitutes while traveling on official government business, his live-in extramarital affairs with numerous foreign women while stationed in foreign countries, and other “high risk” sexual behavior with foreign nationals. JAG Defense worked with the client over a period of 18 months while awaiting his LOI/SOR, facilitating counseling and rehabilitation. After detailed written response to SOR, the Department of the Navy Central Adjudication Facility (DONCAF) found FOR THE APPLICANT and the TS/SCI clearance was granted without the necessity of having to go through a Personal Appearance.

After submitting a detailed written response to the SOR, the Central Adjudication Facility found for the client and GRANTED THE CLEARANCE.

Clearance Granted After Client’s Improper Use of Technology Systems

WASHINGTON, DC - Client received interrogatories from Adjudication Authority concerning events that would fall under Adjudicative Guidelines E - Personal Conduct, and M – Use of Information Technology Systems as a result of improper use of employer provided computer by searching for and viewing inappropriate images, being terminated from one employer as a result of misuse of Information Technology Systems, and a later improper use of Technology Systems at a subsequent employer. After providing a detailed response to the Interrogatories to include steps taken to preclude future similar inappropriate behavior, Adjudication Authority granted the clearance with no further proceedings required.
