GS Employee Retains Clearance
MIDATLANTIC: Federal Government employee in the Department of Defense received an SOR concerning handling of protected information, personal conduct, sexual conduct, criminal conduct, psychological conditions, and financial considerations as a result of allegations of leaving classified material unsecured, failing to protect sensitive information by having it open to public view while on public transportation, disclosing classified information to a family member who then publicly shared that information, bringing classified information home, disclosing a classified location, making threats of violence against members of the activity, engaging the services of a sex worker, suffering from a diagnosed psychological disorder, and failing to pay debts. After presenting the case at a Personal Appearance, to include consideration of protections under PPD-19 (Protecting Whistleblowers with Access to Classified Information) the Personnel Security Appeals Board found FOR THE APPELLANT and the clearance was granted.
Service Member Granted Access to TS/SCI After Multiple Misconducts
MIDDLE ATLANTIC - Active duty service member issued Letter of Intent (LOI)/Statement of Reasons (SOR) from Consolidated Adjudication Facility for allegations falling under Adjudicative Guidelines D – Sexual Behavior, G – Alcohol Consumption, I – Psychological Conditions, and J – Criminal Conduct as the result of imposition of punishment under the Uniform Code of Military Justice (UCMJ) for Violation of Article 92 – Failure to obey a Lawful General Order; Article 120(14) - Indecent Exposure; failure to comply with a letter of warning from the Central Adjudication Facility (CAF) concerning the consequences of future misconduct; self-admitted public intoxication and excessive consumption of alcohol with history of alcohol abuse continuing over several years, with self-destructive behavior; several instances of inappropriate sexual conduct/behavior; diagnosis of Major Depressive Disorder, with persistent symptoms for several years, resulting in a CAF directed psychological conditions evaluation conclusion of a mental health diagnosis which may cause a material defect in the client's ability and/or willingness to properly safeguard classified information and/or perform sensitive duties; Post Traumatic Stress Disorder (PTSD), with recurrent possible, especially when confronted with new stressors, and with the symptoms not currently controlled by medication and likely to persist until appropriate treatment is received. After submission of response to SOR, CAF found FOR THE CLIENT granting access to Top Secret/Sensitive Compartmented Information (TS/SCI) and assignment to sensitive duties.
Navy, Senior Civilian Employee Clearance Restored After Multiple Misconducts
WEST COAST - Department of the Navy, Senior Civilian employee, received Letter of Intent (LOI) to revoke clearance based upon Guidelines: E - Personal Conduct; G - Alcohol Consumption; J - Criminal Conduct; and, I - Emotional, Mental and Personality Disorders, based upon multiple DUI's; counseling from, but denial of consultation with mental health providers; history of participation in alcohol treatment programs before and after DUI offenses; and, refusal to discontinue drinking despite history of alcohol-related incidents. Response to LOI sufficient for DONCAF to restore clearance, without necessity of personal appearance, thereby permitting return by employee to full-time employment after having been placed on administrative leave without pay.
CAF Found for the Client without Personal Appearance
WASHINGTON, DC - Client civilian employee of Department of Defense was issued a Letter of Intent (LOI)/Statement of Reasons (SOR) for Adjudicative Guidelines related to G - Alcohol Consumption, I - Psychological Conditions, F - Financial Considerations, and J - Criminal Conduct related to failure to disclose alcohol counseling or treatment, admission on a number of occasions for detoxification and mental health issues, previous revocation of clearance based upon treatment for alcoholism, arrest for DUI, and recent Bankruptcy. After presentation of a written response to the allegations the Central Adjudication Facility found for the client and granted the clearance without the necessity of having to go through a Personal Appearance.
Client Successfully Regained Security Clearance From Drug Involvement
MIDDLE ATLANTIC - Successfully assisted client on reapplication after denial for security clearance. Client lost clearance due to Adjudicative Guidelines E – Personal Conduct, H – Drug Involvement, and I – Psychological Conditions as result of longstanding history of drug use and multiple misrepresentations on several previous SF86s and throughout numerous background investigation and adjudications processes. Following our guidance, client underwent a year of drug abuse evaluation and random urinalysis testing and psychological evaluations and then was successful in the reapplication after denial process, retaining his job and getting his security clearance back.
CAF Granted Clearance without Necessity of a Personal Appearance
WEST COAST - Client government employee was issued a Statement of Reasons (SOR) from the service's Central Adjudication Facility (CAF) under Adjudicative Guidelines: E - Personal Conduct, G - Alcohol Consumption, H - Drug Involvement, I - Psychological Conditions and J - Criminal Conduct, based upon allegations of DUI, inpatient treatment for substance abuse (alcohol, as well as lawful and unlawful drug use of several substances) and suicidal ideation/overdose attempt, readmission for substance abuse treatment and detoxification, additional out-patient substance abuse treatment, and unusual behavior during the background investigation. After responding to the SOR the CAF granted the clearance without the necessity of a Personal Appearance.
