Clearance Granted for Applicant in Criminal Conduct Due to DUI Case
WASHINGTON, DC - Client defense contractor issued Statement of Reasons (SOR) under Adjudicative Guideline J – Criminal Conduct due to DUI, violation of probation of DUI by consuming alcohol and being arrested while on probation for Felony Criminal Trespass in a different state, resulting in Probation Violation Hearing in the first state and another period of probation in the other state. After presentation of the case at a Hearing the Administrative Judge found FOR THE APPLICANT and granted the clearance.

JAG Defense Succeeded for Client in Reapplication After Denial
WASHINGTON, DC - Client contractor employee retained our assistance for a Reapplication After Denial security clearance adjudication. Client previously had Adjudicative Guidelines E - Personal Conduct and J Criminal Conduct concerns due to - Felony drug conviction, as well as charges for Battery and Violation of Protective Order, and a Bench Warrant for failure to appear, resulting in 10 years confinement in prison. Previous application had resulted in denial. After submitting our reapplication package, the Director, Defense Office of Hearings and Appeals (DOHA) granted the clearance.
JAG Defense Successful with Reapplication after Denial Package
EUROPE - Client active duty military service member was previously denied a security clearance by his service's Central Adjudication Facility based upon unmitigated concerns involving Adjudicative Guidelines: B - Foreign Influence, E - Personal Conduct, F - Financial Considerations, G - Alcohol Consumption, H - Drug Involvement, and J - Criminal Conduct. The specific allegations included: multiple traffic violations, alcohol-related offenses, Assault/Domestic Violence, Criminal Damage to Property, Several Failures to Appear at Court, deliberate misrepresentations on the SF86, and over $25,000 in bad debts listed in a four-page Statement of Reasons. Without a clearance being granted, client would have been unable to complete the necessary years of service to qualify for a retirement. Working with client we were able to submit a reapplication after denial package mitigating all concerns and the client was granted the clearance.
DoS Employee Retained JAG Defense in Clearance Revocation Case
WASHINGTON, DC - Client government employee of Department of State (DoS) as well as being a military Reservist had his clearance revoked by DoS under Adjudicative Guidelines E – Personal Conduct and J – Criminal Conduct due to allegations related to Felony criminal prosecution for Malicious Wounding/Aggravated Assault and Child Abuse, as well as fraudulently obtaining medical care from another's insurance provider, providing false information, and obtaining an apartment for and cohabiting with his girlfriend while still married. Client then retained JAG Defense to assume the lead role in Appealing the revocation of the clearance. After presentation of his case before the DoS Appeal Panel, a finding was made to reverse the revocation, restore the clearance, and return the client to employment.

ASIA - DoD employee stationed at an overseas multi-agency activity issued Letter of Intent (LOI)/Statement of Reasons (SOR) under Adjudicative Guidelines: E - Personal Conduct, J - Criminal Conduct, B - Foreign Influence, G - Alcohol Consumption and K - Handling of Protected Information as a result of failing to comply with reporting of contacts with foreign nationals, deception during a polygraph examination, close personal/intimate contact with a possible agent of a foreign power and married individual, unauthorized outside activities in an overseas location, potential compromise of classified information, destruction of classified information, engaging in an assault resulting in criminal and civil liabilities. After presentation of the case at a Personal Appearance before the Agency review Board the clearance was granted and the employee returned to work.
Clearance Granted for Client with Numerous Allegations
EUROPE: Active duty military member issued Letter of Intent (LOI)/Statement of Reasons (SOR) under Adjudicative Guidelines: B - Foreign Influence, D - Sexual Behavior, E - Personal Conduct, and J - Criminal Conduct as result of allegations of engaging in prohibited financial dealings with foreign national in violation of government regulations, Violations of several Articles of the Uniform Code of Military Justice (UCMJ) for which disciplinary action was imposed for false official statements, disobedience of orders, conduct unbecoming an officer, and adultery. After responding in writing to the SOR the Central Adjudication Facility granted the clearance.
Clearance Granted by Personnel Security Appeals Board
MIDDLE ATLANTIC - Client government employee within the Department of Defense issued Letter of Intent (LOI)/Statement of Reasons (SOR) under Adjudicative Guidelines: G - Alcohol Consumption and J - Criminal Conduct as a result of a DUI conviction with in-patient alcohol rehabilitation treatment, followed by a relapse and DUI with out-patient counseling, followed by a relapse and DUI with out-patient counseling. After working with client to obtain additional alcohol consumption counseling support and demonstrating at a Personal Appearance before an Administrative Judge the client's commitment to total abstinence along with changed circumstances supportive of abstinence, client's clearance was granted by the Personnel Security Appeals Board.
Clearance Granted after SOR under Numerous Guidelines
MIDDLE ATLANTIC - Client Federal Government employee within the Department of Defense was issued Statement of Reasons (SOR) under Adjudicative Guidelines: E - Personal Conduct, J - Criminal Conduct, and D - Sexual Behavior as a result of circumstances and events that flowed from a person met through a social network site that raised questions of judgment, behavior, conduct, potential for extortion and coercion as a result of behavior taking place with and events surrounding interactions with that individual. After submitting a written response to the SOR, however, the Central Adjudication Facility granted the clearance/ access.
CAF Granted Clearance without Necessity of a Personal Appearance
WEST COAST - Client government employee was issued a Statement of Reasons (SOR) from the service's Central Adjudication Facility (CAF) under Adjudicative Guidelines: E - Personal Conduct, G - Alcohol Consumption, H - Drug Involvement, I - Psychological Conditions and J - Criminal Conduct, based upon allegations of DUI, inpatient treatment for substance abuse (alcohol, as well as lawful and unlawful drug use of several substances) and suicidal ideation/overdose attempt, readmission for substance abuse treatment and detoxification, additional out-patient substance abuse treatment, and unusual behavior during the background investigation. After responding to the SOR the CAF granted the clearance without the necessity of a Personal Appearance.
